For Tenants

Are You Paying Too Much Rent?

Millions of NYC apartments are rent stabilized. Yours might be one of them.

The Situation

You suspect your apartment should be rent stabilized, but your landlord is charging market rate. Or you know it's stabilized, but you think the rent is higher than it should be. The rent history is confusing, and you're not sure if you've been overcharged.

What We Do

We obtain your apartment's rent history from DHCR and audit it for irregularities. We identify illegal rent increases, improper preferential rent clauses, and fraudulent Individual Apartment Improvements (IAIs). If overcharges are found, we file a complaint with DHCR or pursue the case in court.

What You Can Expect

Rent reduction to the legal regulated rent, refund of overcharges (up to 6 years with interest), treble damages if the overcharge was willful, and a stabilized lease going forward.

Common Mistakes to Avoid

  • Assuming your apartment isn't rent stabilized without checking
  • Not requesting your rent history from DHCR
  • Signing a preferential rent lease without understanding it
  • Waiting too long to file (4-year lookback for overcharges)

Relevant Laws

  • NYC Rent Stabilization Law
  • Rent Stabilization Code (9 NYCRR)
  • Housing Stability and Tenant Protection Act (2019)
