For Tenants

Your Landlord Has to Keep It Livable

No heat, pests, mold, or leaks? That's a violation. We force repairs.

The Situation

Your apartment has serious problems: no heat or hot water, a rodent or roach infestation, mold, leaks, broken windows, or other hazardous conditions. You've complained to your landlord, but nothing gets fixed. HPD has issued violations, but the landlord ignores them.

What We Do

We file an HP Action in Housing Court to compel repairs. The court can order your landlord to fix the problems immediately, impose civil penalties, and in severe cases, appoint an administrator to make repairs. We can also pursue rent abatements for the time you've lived in substandard conditions.

What You Can Expect

Court-ordered repairs, civil penalties against your landlord, and rent abatements for the period you lived with violations. In some cases, we can get you out of your lease without penalty if conditions are severe enough.

Common Mistakes to Avoid

  • Not documenting conditions with photos and videos
  • Not calling 311 to create an official record
  • Withholding rent without court approval
  • Moving out without pursuing your legal remedies first

Relevant Laws

  • Real Property Law §235-b (Warranty of Habitability)
  • NYC Admin Code §27-2001 et seq. (Housing Maintenance Code)
